$2,000 Flat Fee for an Agreed Divorce

1.       What is the process of an Agreed Divorce? 

An Agreed Divorce proceeds just like a regular divorce, but with a lot less headache and fees. 

  • You and your spouse will come in to our offices for a consultation.  Before there is any discussion, you will both be advised as to attorney/client privilege and waiver thereof.

  • We will discuss whether you are eligible for an Agreed Divorce.

  • If you are, we will collect your $2,000 fee, and at that time you will have to decide which one of you is going to be our client and the “petitioner.” The other spouse will be the “respondent.”

  • We will then discuss with you in detail your agreements.

  • We will get some information from you, and if you do not have all that information at the time of the consultation, can bring it back to us later.

  • We take it from there, and will file a “Petition for Dissolution” with the clerk of the circuit court in the jurisdiction you live in.

  • We will then file your spouse’s “Waiver of Summons,” “Appearance,” and “Answer.” If you have children, there are additional forms we will file containing information about your children.

  • We will then prepare a “Settlement Agreement,” which is essentially a contract between the two of you, and which sets forth what are your agreements concerning property, debts, assets, and if you have children, custody and visitation.

  • Finally, we will go to court to finalize your divorce. Only one of you needs to be present, whoever is the one who is our client and also the “petitioner.” At that court date, we will show the judge your settlement agreements, ask you a few dozen questions before the judge, and that is it.

2.      How long will it take?

An Agreed Divorce can take place as quickly as a month after filing, or longer if it takes more time for you to complete your paperwork, get information, or take a parenting class.

3.       Can I do an Agreed Divorce if my spouse lives in another state or country?

Usually, yes.  As long as your spouse agrees to the divorce and agrees to execute the necessary paperwork, you should be able to do an Agreed Divorce.

4.      Will I still get quality legal advice doing an Agreed Divorce?
