Entitled to a hearing:

  • You are entitled to a hearing before a judge if you file a written request to challenge your summary suspension within 90 days from when you received notice of the suspension.

DRIVING WHILE SUSPENDED:

  • New legislation now makes it a felony to drive while your license is suspended for a DUI related offense.*

3.  JUDICIAL DRIVING PERMIT:

  • If you are considered a first offender, you may be eligible for a Judicial Driving Permit (JDP).
  • A JDP allows you to (a) drive to and from work and in the scope of your employment; (b) to and from medical and/or alcohol treatment; and/or (c) to and from school.

To receive a JDP, you must submit a Petition and:

  • Alcohol evaluation.
  • And one or more of the following:

  • A letter from your employer stating the days and hours you work;
  • A certified class schedule; and/or
  • A letter from a counseling/medical agency stating days/hours of treatment or counseling.
  • Effective Date of the JDP:

    • The JDP starts after the first 30 days of the suspension. It is effective to the end of the suspension.
    • Thus, even with a JDP you cannot drive at all for the first 30 days of the suspension
