Driving While Suspended

  • How Can I get Court Supervision?

    It may be possible to enter a negotiated plea (plea bargain) with the state’s attorney for a recommended sentence of Supervision.* You may also receive Supervision from the judge by entering a “blind plea” (without a recommendation from the state’s attorney.*) Your attorney may also be able to hold a conference with the judge and the state’s attorney.*

RESTORING YOUR DRIVING PRIVILEGES

You have a much better chance of receiving Court Supervision and/or a smaller fine or even less jail time if you are able to clear your suspension before you go to court.*Additionally, if you are able to clear your license you will not run the risk of receiving another DWLS charge and you may begin driving immediately!  You do not have to wait until you go to court.*

  • How Can I Get My License Re-Instated?

    In order to restore your driver’s license you must clear the basis of your suspension.* Many people have more than one basis for suspension and each one must be cleared before you can drive.  You must also pay a re-instatement fee to the Secretary of State.
    • You Should: Obtain a copy of your driving record, called an “Abstract For Court Purposes”, from the Secretary of State to determine the basis for your suspension.  (The fee is $6.00.) 
  • DUI Based Suspension/Revocation:
    Mandatory minimum sentences may apply if the basis for the suspension or revocation is for a prior DUI.  These sentences begin with a minimum 10 days in jail or 300 hours community service.*
